Terms of Service
The terms governing use of the Mars Elite Recruiting platform.

1. Acceptance of terms
By creating an account or otherwise accessing the Mars Elite Recruiting platform ("the Service"), operated by Mars Elite Group LLC ("Mars Elite", "we", "us"), you agree to be bound by these Terms of Service. If you are accepting on behalf of an organisation, you represent that you have authority to bind that organisation.
2. The Service
The Service provides recruitment workflow tools for employers, recruiters, and candidates, including job posting, application management, interview scheduling, offer management, employer invoicing, and related communications.
3. Accounts and eligibility
You must provide accurate registration information and keep your credentials confidential. You are responsible for activity that occurs under your account. Employer and recruiter accounts are provisioned by invitation from an organisation administrator; candidate accounts may self-register.
4. Recruiting and staffing engagements
Mars Elite Recruiting provides recruiting/staffing workflow tools and, where separately agreed, recruiting or staffing services. Use of the platform does not by itself create a placement guarantee, an employment relationship, or a guarantee of hire. Any placement guarantee, replacement guarantee, exclusivity, or similar commercial commitment applies only if and to the extent expressly stated in a signed engagement agreement, order form, or invoice between Mars Elite and the employer/client.
5. Fees, invoicing, and payment
Where Mars Elite and an employer/client have agreed to recruiting or staffing services, fees are due as stated in the applicable engagement agreement, order form, or invoice. Invoices and payment due dates are governed by the applicable engagement, order, or invoice. Where Mars Elite Recruiting offers online payment of an invoice, payment may be processed through approved third-party payment processors (for example, Stripe and/or PayPal, where and when enabled); Mars Elite does not receive or store your card or bank account details. Mars Elite Recruiting also accepts negotiated offline payment methods (such as bank transfer, wire, or check) at its discretion, recorded by authorised Mars Elite personnel. Taxes, if applicable to an engagement, are handled according to applicable law and the terms of the applicable agreement or invoice.
6. Refunds, credits, and cancellations
Refunds, credits, replacements, or cancellation rights are available only where expressly stated in the applicable written engagement agreement, order form, invoice, or as required by applicable law. If you believe a charge on your account is incorrect, contact us promptly via our Contact page so we can review it; raising a dispute with us first does not waive any right you may separately have with your payment provider, but a chargeback with your bank or card issuer does not by itself resolve or replace the dispute process described in the applicable engagement agreement.
7. Job and application information
Candidates control what they submit through the Service, including resumes and application materials. Employers and recruiters with legitimate access to a requisition may view application materials submitted to that requisition. See our Privacy Policy for how we handle personal data.
8. Acceptable use
You agree not to misuse the Service - including submitting false information, attempting to access data you are not authorised to view, or interfering with the Service’s operation. Access is governed by role-based permissions; attempts to circumvent them may result in suspension.
9. AI-assisted features
Certain features use AI to assist with tasks such as summarising resumes, structuring job requirements, or suggesting candidate-to-role alignment. These features are advisory: they are designed to support human judgement, not to make final hiring, rejection, or compensation decisions on their own, and Mars Elite does not warrant the accuracy or completeness of AI-generated output.
10. Third-party services
The Service may rely on third-party providers for functions such as email delivery, analytics, error monitoring, cloud hosting, and, where enabled, payment processing. Your use of a feature backed by a third-party provider may also be subject to that provider’s own terms.
11. Intellectual property
The Service, including its software, design, and content, is owned by Mars Elite Group LLC and its licensors. These Terms do not grant you any rights to our trademarks or branding.
12. Termination
We may suspend or terminate access to the Service for a violation of these Terms, including non-payment of undisputed fees due under an applicable engagement. You may stop using the Service at any time; certain records (e.g. audit, billing, and compliance records) may be retained as required by law or our data retention policy.
13. Disclaimers and limitation of liability
The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Mars Elite Group LLC is not liable for indirect, incidental, or consequential damages arising from use of the Service, and our total liability arising out of or relating to the Service will not exceed the amount you or your organisation paid to Mars Elite for the Service in the twelve months preceding the claim, except where a signed engagement agreement expressly states otherwise.
14. Indemnification
You agree to indemnify and hold Mars Elite Group LLC harmless from claims, damages, and reasonable expenses arising from your breach of these Terms or your misuse of the Service, except to the extent caused by Mars Elite’s own breach of these Terms or violation of law.
15. Governing law
These Terms are governed by the laws of the State of Illinois, United States, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Service that is not resolved informally is subject to the exclusive jurisdiction of the state and federal courts located in Cook County, Illinois.
16. Changes to these terms
We may update these Terms from time to time. Material changes will be communicated through the Service. Continued use after a change constitutes acceptance of the updated Terms.
